Yes and yes.
We use to "pool hop" (me and an old boyfriend) a lot after going out to bars. We lived in an area that had a lot of apartment complexes and they all had pools. Never got caught. We nearly had to call 911 though...after we had dipped, we were leaving (there was another couple with us) and the other girl went to jump the fence and fell backwards (back towards the concrete around the pool). Fortunately, my boyfriend was right behind her and caught her on the way down. THAT would have stunk because it would have been a bloody mess!

in my own backyard, yes - but it was kinda public cause we did not have a privacy fence up then (in was late at night though)
